Massachusetts Clerks Not Required to Ask for Proof of Residency

Clerks in Massachusetts, who underwent training yesterday in closed door sessions, are allowed to use their discretion as to the proof of residency of couples seeking to be married in the state beginning May 17th. The Cape Cod Times reported that "[a] sworn affidavit - including the state's revised Notice of Intention Of Marriage form, which now asks about intended residence - would be sufficient." Discretion was left to clerks to accept the affidavit or to require additional documentation proving residency or evidence of intention to move to Massachusetts. Whatever proof is required by clerks, it must be applied consistently to all couples.
